Rentpoint Terms of Use and Privacy Policy

Acceptance of This Agreement

By creating an account on or otherwise using rentpoint.store (the "Platform"), you agree to be bound by these Terms and Conditions and the Privacy Policy. If you do not agree, you must not use the Platform.

What Rentpoint Is

Rentpoint is software that lets a rental business (a "Vendor") create its own online storefront, list items for hire and accept bookings with a deposit paid online. Rentpoint provides the tools only. It is not a marketplace, it does not advertise for you or source customers on your behalf, and it is not a party to any rental agreement between a Vendor and that Vendor’s customer.

Vendor Responsibilities

As a Vendor you are solely responsible for: - The accuracy of your listings, pricing, availability and business information - Owning or having the right to rent out the items you list - Fulfilling each booking, collecting the outstanding balance, and handling handover, returns, damage and security deposits with your customer - Providing customer support for your rentals and resolving any dispute with your customer - Complying with all laws, licences, taxes and insurance requirements that apply to your rental business

Bookings, Deposits and Fees

Customers reserve items by paying a deposit online. Card payments are processed by Stripe and the deposit is routed to the Vendor’s connected Stripe account; the Vendor must complete Stripe onboarding before taking bookings. The remaining rental balance is collected by the Vendor directly from the customer, outside the Platform. Rentpoint may charge a subscription and/or a platform fee, disclosed to the Vendor before it applies. Rentpoint is not responsible for the rental itself, the balance, item condition, refunds, chargebacks or disputes between a Vendor and their customer.

No Marketplace or Agency Relationship

Rentpoint does not introduce customers to Vendors and does not act as an agent, broker, insurer or reseller for either party. Any contract for the hire of an item is made solely between the Vendor and the customer. Rentpoint gives no warranty as to the items listed, the conduct of any Vendor or customer, or the outcome of any booking.

Use of the Platform

You agree to: - Use the Platform lawfully - Provide accurate information - Avoid posting content that infringes intellectual property or third-party rights - Not interfere with or disrupt the Platform Rentpoint reserves the right to suspend or terminate accounts that breach these Terms.

Intellectual Property

All materials that make up the Platform, including software, text, graphics, logos and content, are owned by Rentpoint or its licensors. You may use them only to access and use the Platform as intended. Any other use requires prior written consent. You retain ownership of the content you upload (such as item photos and descriptions) and grant Rentpoint a licence to host and display it so your storefront can function.

Limitation of Liability

The Platform is provided "AS IS" and "AS AVAILABLE." Rentpoint does not guarantee uninterrupted access or error-free operation. To the extent permitted by law, Rentpoint shall not be liable for loss of data or access, lost rental income, or for indirect, incidental or consequential damages arising from Platform use. Nothing in these Terms limits Rentpoint’s liability for death or personal injury caused by its negligence, or for other liability that cannot be excluded by law.

Indemnity

You agree to indemnify Rentpoint against any claims, damages or expenses arising from your breach of these Terms, your use of the Platform, the content you upload, or any rental transaction you enter into with a customer.

Changes to Terms

Rentpoint may amend these Terms at any time. Material changes affecting fees or user rights will be communicated with at least 14 days’ notice. Continued use after changes take effect constitutes acceptance.

Privacy and Data Collection

This section explains how we collect, use, store and share personal data when you use our Platform.

Data Collected

We may collect: - Identification and contact information (name, email, phone) - Account credentials and preferences - Vendor storefront and business information (business name, storefront URL, item listings, payout account status) - Booking details from customers (name, email, phone, rental dates and deposit paid) - Technical data (IP address, device, logs)

Purpose and Legal Basis

We process your data to: - Create and manage your account and storefront (performance of contract) - Operate and improve the Platform (legitimate interest) - Process deposit payments and enable payouts (performance of contract) - Communicate service updates and, with your consent, promotions - Comply with legal obligations

Data Sharing

We do not sell your data. We may share it with: - Stripe, to process deposit payments and route payouts to Vendors - Service providers (hosting, email delivery, analytics) - Regulators or law enforcement as required by law

Retention

Data is retained only as long as necessary to provide the Platform and comply with legal obligations. Account data is retained for a maximum of 5 years after account closure, unless otherwise required by law.

Cookies and Tracking

We use cookies and similar technologies to operate the Platform and improve the user experience. You may manage cookies through your browser settings.

User Rights

Under GDPR, you have the right to: - Access your personal data - Correct inaccurate data - Request erasure - Restrict processing - Object to processing - Request data portability - Lodge a complaint with the Czech Office for Personal Data Protection

Security

We implement appropriate technical and organizational measures to protect your data against unauthorized access, disclosure or destruction. Card details are handled by Stripe and never stored on our servers.

Applicable Law and Jurisdiction

These Terms and Privacy Policy are governed by Czech law. The courts of the Czech Republic, with Prague as the place of performance, shall have exclusive jurisdiction over disputes, subject to mandatory consumer protection rules.
